Prenuptial or Antenuptial agreements are detailed documents that are difficult to describe in a brief overview of this nature, but we hope that this provides you with some general and helpful information to consider, which is what is intended.

  • Part of what is often encompassed in these agreements is a mechanism by which the growth of one party’s pre-marriage assets do not become marital property or property over which the other party may have a claim. But the contract can also state that certain assets are shared, parts of certain assets are shared, or that upon one party’s death, the asset goes to the other party, or may other possible divisions and protections.

  • Essentially, this means that you are creating a multiple purpose agreement: What belongs to whom if you do not marry, what will stay separate and what will co-mingle if you do marry, what will be whose in the unfortunate event that a marriage ends.

These agreements deal with estate rights, insurance and retirement beneficiaries, business interests and a myriad of other things. Often there is a provision to somehow protect a non-monied spouse upon the death of the monied spouse by way of an insurance policy, or as part of estate planning within the document itself.

This type of agreement also needs to address property not yet owned by either party, or what will happen if, during the marriage or relationship, one party or the other purchases certain assets. Keep in mind that “property” means both real property and personal property, sometimes referred to as personalty.

Your agreement may well set forth items that certain items coming into the marriage will be marital property, but most importantly, you want to establish what will never become marital property for division by a Court at a future date.  You want to override statutory estate rights and statutory requirements for beneficiaries on various accounts that your spouse would otherwise be entitled to.
